Terms and Conditions of Cinnamellow

Welcome to Cinnamellow, your go-to destination for custom cakes. By placing an order or using our website (cinnamellow.com.au), you agree to be bound by the following Terms & Conditions. Please read them carefully before you place your order.

These Terms & Conditions apply to all orders placed through our website, by email, or via any other communication channel. Cinnamellow is a registered Australian business (ABN 476 2018 4198) based in Melbourne, Victoria.

All orders at Cinnamellow are subject to availability and acceptance. An order is only confirmed once full payment has been received, and a confirmation has been sent to you via email or message. Until payment is received and confirmation is issued, your order date and time slot are not reserved. We reserve the right to decline any order at our discretion. For custom cakes, please ensure that all design details, flavors, sizes, and special requests are communicated clearly at the time of ordering. Cinnamellow is not responsible for errors based on incomplete or unclear information provided by the customer.

All prices for Cinnamellow custom cakes are listed in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice, and the price at the time of your confirmed order will apply. Quotes provided for custom orders are valid for 7 days from the date of issue. Full payment is required at the time of order confirmation. We accept payment via Square, PayPal, and other payment methods listed on our website.

Due to the handcrafted and perishable nature of our custom cakes at Cinnamellow, we have a strict no-cancellation policy. All orders confirmed upon payment are final. We do not accept cancellations or offer refunds once an order has been confirmed and payment received. If you need to change your order date, please contact us as soon as possible at hello@cinnamellow.com.au. Date changes are subject to availability and are not guaranteed. In the unlikely event that Cinnamellow is unable to fulfil your confirmed order, you will receive a full refund. Your rights under the Australian Consumer Law are not affected by this policy. If a product is faulty, not as described, or fails to meet a consumer guarantee, please contact us immediately.

Cinnamellow custom cake and dessert orders require a minimum of 48 hours notice. For larger or highly detailed custom cakes, we recommend allowing 5-7 days or more. When it comes to custom designs, we will strive to replicate the inspiration images you provide. However, please note that since all our creations are handcrafted, minor variations in color, design, or finish may occur. Any changes to a confirmed custom cake order should be requested as soon as possible and are subject to our approval, along with any additional charges if applicable. Cinnamellow reserves the right to make reasonable design adjustments when an exact replication is not technically feasible.

Cinnamellow offers delivery exclusively across the Melbourne Metro area. Unfortunately, delivery outside this region is not available. Please note that delivery fees apply and will be clearly communicated at the time of ordering. Our estimated delivery times may vary due to traffic or other circumstances beyond our control, and Cinnamellow is not liable for any delays caused by external factors. It is the customer's responsibility to ensure that someone is available to receive their custom cakes at the agreed delivery time and address. Once a delivery has been completed and accepted, Cinnamellow cannot be held responsible for any damage that occurs thereafter.

Pickup is available from our Forest Hill location by prior arrangement only for custom cakes. Pickup times will be confirmed at the time of ordering. Once an order has been collected, Cinnamellow is not responsible for any damage that occurs during transport. Uncollected orders will be held for a maximum of 24 hours. After this time, Cinnamellow reserves the right to dispose of the order, and no refund will be issued.

Cinnamellow products, including our custom cakes, are made in a home kitchen that handles common allergens, including but not limited to: gluten/wheat, eggs, dairy/milk, nuts, and soy. While we take care in our preparation, we cannot guarantee that our Cinnamellow products are free from allergens. It is the customer's responsibility to inform us of any allergies or dietary requirements at the time of ordering. Cinnamellow is not liable for any allergic reactions resulting from the consumption of our products.

Cinnamellow reserves the right to photograph all custom cakes and share them on our website, social media platforms, and marketing materials. If you do not wish for your order to be featured, please notify us in writing at the time of placing your order. 

By tagging Cinnamellow in your social media posts featuring our custom cakes, you grant us permission to reshare your content on our platforms.

All Cinnamellow custom cakes and products are freshly made to order using premium quality ingredients. Our offerings are best consumed on the day of delivery or pickup. Storage instructions will be provided with your order. Cinnamellow is not responsible for product quality if storage instructions are not followed.

To the maximum extent permitted by Australian law, Cinnamellow's liability for any claim arising out of or in connection with an order for custom cakes is limited to the value of that order. Cinnamellow is not liable for any indirect, incidental, or consequential loss or damage.

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

Cinnamellow reserves the right to update these Terms & Conditions at any time. Changes will be posted on our website, www.cinnamellow.com.au, along with an updated effective date. Continued use of our website or placing orders for our custom cakes after changes are posted constitutes acceptance of the updated terms.
